DWI – Driving While Impaired

A charge of Driving While Impaired is a very serious charge, that is time-sensitive. If you are charged with Driving While Impaired, it is important to consult with an experienced DWI attorney as soon as possible.

Why is it important and what we do? A DWI arrest is a misdemeanor charge that if convicted, the criminal conviction will permanently stay in your record and cannot be expunged. During our initial court appearance, we request that the State provide us with all the evidence collected during the traffic stop and the arrest. We attend several court dates while we collect State’s evidence, which include a video of your arrest. After a thorough assessment of your case, we develop a strategy for your case. A criminal charge is not the same as criminal conviction, you are presumed innocent until proven guilty and the State will have to prove every element of the crime in order to convict you.

What are the fees? Our fees are usually flat rate fees that cover your legal fee from start to finish.

If you can’t come in for an in-person consultation, you can send us copies of your paperwork and we will provide you with a quote. We need your citation, your breath test result slip and any other paperwork given to you at the time you were charged.

You can get that paperwork to us in three different ways, use the method is most convenient for you:

  1. scanning, or taking a picture of your paperwork and sending as an e-mail attachment to: admin@herhuskylawoffice.com or
  2. by dropping it off at our office in person (if you or someone on your behalf is in the Wake County area – client dropbox available M/F from 8-5pm; or
  3. by mailing to: 1135 Kildaire Farm Road, Suite 200, Cary NC 27511.

  • We MUST have your FULL legal name. Usually this will be as it appears on your Driver License or other current government issued ID.
